14 連續(xù)承運(yùn)人 14SUCCESSIVE CARRIERS 根據(jù)一本客票或一本客票和與其有關(guān)而填開的連續(xù)客票由幾個(gè)連續(xù)承運(yùn)人共同承擔(dān)的運(yùn)輸，應(yīng)視為是一個(gè)單一運(yùn)輸。 Carriage to be performed under a ticket or under a ticket and any conjunction ticket by two or more by two or more [m12]successive carriers shall be regarded as a single operation. 15 損害責(zé)任 15LIABILITY FOR DAMAGE 15.1 本條件中由廈航辦理的國際運(yùn)輸，除不屬于公約適用的國際運(yùn)輸外，均適用公約關(guān)于責(zé)任規(guī)則和限額的規(guī)定。 15.1 International carriage herein conducted by Xiamen Airlines is subject to the rules and limitations relating to liability established by the Convention unless such carriage is international carriage to which the Convention does not apply. 15.2 對(duì)公約適用的國際運(yùn)輸以外的運(yùn)輸，廈航將按照蒙特利爾公約相關(guān)規(guī)定承擔(dān)賠償責(zé)任。 15.2 In the event of international carriage to which Convention does not apply, Xiamen Airlines shall assume the liability for any damage in accordance with relevant provisions of the Montreal Convention 15.3 在與上述條款不相沖突的情況下，無論公約是否適用： 15.3 To the extent not in conflict with the provisions of the preceding paragraph 15.1 and 15.2, and whether or not the Convention applies: 15.3.1 廈航僅對(duì)其履行運(yùn)輸時(shí)發(fā)生的損害承擔(dān)責(zé)任。廈航為其他承運(yùn)人運(yùn)輸?shù)暮桨嗵铋_客票或辦理行李托運(yùn)，只作為該承運(yùn)人的代理人，廈航不對(duì)該承運(yùn)人履行運(yùn)輸時(shí)發(fā)生的損害承擔(dān)責(zé)任。但對(duì)于托運(yùn)行李，旅客有權(quán)對(duì)客票或行李票上列明的第一或最后承運(yùn)人索賠的權(quán)利。 15.3.1 Xiamen Airlines is liable only for damage occurring during its performance of carriage. If Xiamen Airlines, as an agent to issue a ticket or accept checked baggage for carriage performed by another carrier, Xiamen Airlines assumes no liability for damage occurring during the performance of carriage by such carrier. Nevertheless with respect to checked baggage the passenger shall also have the right to make a claim against the first or last carrier shown on the ticket or baggage check. |
